MD Driving – Terms of Service

These Terms of Service apply to driving lessons, coaching sessions, courses and other services provided by MD Driving. By booking a lesson or service, you agree to the terms below.

1. Booking & Payment

  • Full payment is required at the time of booking to secure your lesson slot.
  • Unpaid lessons are not confirmed and may be offered to other learners.
  • Block bookings and course payments secure priority scheduling and structured progression.

2. Cancellation & Missed Lessons

  • A minimum of 48 hours’ notice is required to cancel or reschedule a lesson.
  • Lessons cancelled within 48 hours, or missed without sufficient notice, are charged in full.

Exceptions may be considered for:

  • Severe weather
  • Sudden illness
  • Genuine emergencies

Frequent short-notice changes may result in refusal of future bookings to maintain consistency and safety.

Instructor Cancellation

If the instructor needs to cancel a lesson at short notice, MD Driving will:

  • Offer a replacement lesson at the earliest convenient time, or
  • Provide a full refund or credit for the cancelled lesson.

Every effort will be made to notify learners as soon as possible.

3. Ongoing Commitment & Lesson Structure

MD Driving operates a structured approach to learning rather than ad-hoc tuition.

  • Lesson slots are offered on the understanding of ongoing commitment.
  • Booking multiple lessons indicates an intention to maintain consistent training and skill development.
  • Long gaps between lessons can affect skill retention and may require recap sessions.

4. Block Bookings & Prepaid Tuition

  • Prepaid lessons are intended for continuous training.
  • If you pass your practical test before completing a block booking, completed lessons will be recalculated at the standard lesson rate and any remaining balance refunded.
  • If lessons are suspended for 12 weeks or more, any remaining prepaid tuition will be forfeited unless otherwise agreed.

5. Lesson Start & Finish Locations

  • Start and finish locations must be agreed at the time of booking.
  • Last-minute changes may reduce available lesson time where changes would cause disruption to other learners or scheduled tests.

6. Instructor Authority & Safety

The instructor has final responsibility for decisions relating to road safety, lesson continuation, early termination and whether a learner is ready to take a practical driving test.

Lessons may be stopped without refund if the learner:

  • Is under the influence of alcohol or drugs
  • Behaves aggressively or dangerously
  • Ignores reasonable safety instructions

Safety always takes priority.

7. Driving Test Bookings & Vehicle Use

  • Practical test dates must be agreed with the instructor before booking where the learner intends to use the MD Driving vehicle.
  • Use of the training vehicle for a practical test is charged at the applicable lesson rate.
  • MD Driving reserves the right to refuse use of the vehicle if the learner is not considered sufficiently prepared or safe to take the test.
  • For safety, support and observation purposes, the instructor may sit in the rear seat of the vehicle during a practical driving test.

8. Practical Test Cancellations

  • If the instructor's vehicle becomes unavailable due to illness or mechanical failure, any test-day vehicle hire fee paid to MD Driving will be refunded.
  • If the DVA cancels a practical test, the test fee is normally dealt with by the DVA in accordance with their own cancellation and refund arrangements.
  • Lessons booked for that day remain subject to the 48-hour cancellation policy.

9. Punctuality

  • Lessons begin and end at the scheduled time.
  • Late arrival by the learner reduces available lesson time but does not reduce the lesson fee.
  • If the instructor is late, the lesson will be extended where reasonably possible, or a partial refund or credit may be offered at MD Driving's discretion.

10. Lesson Fee Changes

  • MD Driving reserves the right to change lesson fees with appropriate notice.
  • Prepaid lessons already booked and confirmed will remain at the agreed rate.

11. Use of Media & Marketing

  • From time to time, MD Driving may take photographs, videos or recordings during lessons for use in marketing, social media or promotional content.
  • No personal information will be deliberately shared beyond what is reasonably required for the content being published.
  • Learners may opt out of appearing in marketing material by notifying MD Driving in writing before the relevant lesson.

12. Learner Responsibilities

Learners must:

  • Hold a valid provisional licence or other appropriate entitlement to drive.
  • Meet the required legal eyesight standards.
  • Inform the instructor of any health, medication or other circumstances that may affect their ability to drive safely.
  • Arrive prepared, rested and ready to participate in the lesson and respond to feedback.

Progress depends on active participation, practice and commitment.

13. Professional Conduct

MD Driving is committed to maintaining a respectful and professional learning environment.

Abusive language, inappropriate behaviour, threatening behaviour or repeated disregard for reasonable guidance may result in termination of services.

14. Driver Responsibility

Learners are responsible for:

  • Any fines, penalties or breaches of traffic legislation incurred during lessons where the learner is responsible.
  • Ensuring their licence and provisional entitlement remain valid.
  • Complying with all legal requirements and conditions relating to their driving.

15. Complaints Procedure

If you have a concern about your lessons or service, please raise it with MD Driving as soon as possible so that it can be addressed.

Where a complaint cannot be resolved directly, learners may seek further guidance from the relevant Northern Ireland driving instructor regulatory authority.

16. Data & Privacy

Personal information is used for purposes including scheduling, training records, communication, insurance and legal compliance, in accordance with applicable UK data protection legislation.

Agreement

By booking a lesson or service with MD Driving, you confirm that you have read and understood these Terms of Service and agree to comply with them.

Your progress is a shared responsibility. MD Driving will provide professional instruction, guidance and support; you are responsible for engaging with the learning process and complying with all legal requirements while driving.
